Abstract

The responsibilities of the curator in managing and resolving the bankruptcy of PT Pelita Propertindo Sejahtera are: to coordinate with the supervisory judge, determine the supervisory judge regarding the first creditor meeting, limit for submitting bills and verification meetings, announce the bankruptcy situation in newspapers and daily news of the Republic of Indonesia, Notifying the bankruptcy decision and holding a meeting with the Board of Directors of PT Pelita Propertindo Sejahtera, asking for documents to be submitted by the debtor, determining the seal of bankruptcy, giving direction to the board of directors regarding the consequences of bankruptcy, sending invitations to the first creditor meeting to the bankrupt debtor and creditors, accepting creditor registration and a list of provisional creditors. The legal measures that can be taken by the curator in carrying out the settlement of PT Pelita Propertindo Sejahtera's bankruptcy are to secure and maximize the bankruptcy assets, on August 30, 2010, the PT PPS Curatorial Team has filed an the letter of the application to the Supervisory Judge Number; 1018 / BN-ABA-AK / PPS / VIII / 2010 regarding Application for Permit to Sell Bankruptcy. On September 1, 2010, the Supervisory Judge issued a stipulation No. 73 / Pailit / 2009 / PN.Niaga.Jkt.Pst, which essentially approved the sale of the bankruptcy property belonging to PT PPS. The bankruptcy assets sold were shares of PT PPS in PT Oceania Development totaling 128,000 (one hundred twenty eight thousand) shares to PT Cipta Kreasi Harmoni at a price of Rp. 130,000,000,000, - (one hundred and thirty billion rupiah) and an agreement for the return has been made. Regarding the plan to sell bankruptcy assets, the Curatorial Team of PT PPS has sent a letter to the Director of PT Oceania Development Number: 142 / BN-ABA-AK / PPS-Pailit / XI / 2010 dated September 6, 2010 regarding a Request for an Extraordinary GMS. On September 17, 2010, the Extraordinary General Meeting of Shareholders of PT Oceania Development was held. The meeting has not resulted in a resolution and is still suspended as of October 11, 2010.
